PALESTINE AND INTERNATIONAL LAW of a Government in Palestine in 1948 by a group of alien immigrants, whether or not claiming to act under the authority of an invalid UN resolution, was an unlawful usurpation of political power that legitimately belonged to the original inhabitants. Similarly, the forcible seizure of a large area of Palestine by such a Govern- ment, whether such area fell within or outside the boundaries fixed by an invalid UN resolution, was an unlawful usurpation of a territory that legitimately belonged to the original inhabitants. The third aspect of Israel's illegitimacy, namely, the absence of any legal basis in international law for its establishment and for its proclamation of state- hood, will be considered in the next section.
